Limited Liability Statement and Waiver of Liability
Prairie Services LLC ("Company," "we," "us," or "our") provides handyman, repair, maintenance, and related services as an independent contractor. While we perform Services with reasonable care consistent with industry standards, you agree to the following binding limitations and waiver:
- Waiver and Release for Ordinary Negligence.
To the fullest extent permitted by South Dakota law, you hereby waive, release, discharge, and covenant not to sue the Company, its owners, officers, employees, agents, subcontractors, or affiliates for any claims, damages, losses, or liabilities (including property damage, personal injury, or other harm) arising from or related to the Services, even if caused by the ordinary negligence of the Company or its representatives. This waiver applies regardless of legal theory (contract, tort, strict liability, etc.). - No Warranties.
Services and any related information are provided "AS IS" without warranties, express or implied, including merchantability, fitness for a particular purpose, or non-infringement. - Limitation of Liability.
Our total aggregate liability for any claims related to the Services shall not exceed the amount you actually paid us for the specific job, or $1000, whichever is less. We shall not be liable for indirect, consequential, special, incidental, exemplary, or punitive damages. - Assumption of Risk.
You acknowledge that home repair inherently involves risks (e.g., pre-existing conditions, latent defects, unforeseen issues). You assume all such risks. - Exceptions.
This waiver does not apply to claims arising from gross negligence, willful or wanton misconduct, reckless conduct, intentional acts, or fraud. - Indemnification.
You agree to indemnify and hold us harmless from claims by third parties arising from your instructions, property conditions, or breach of this agreement (subject to South Dakota law).
This constitutes part of our agreement. If any part is unenforceable, the remainder remains in effect. Last updated: 1/1/2026
